Terms of Service

1. Agreement to Terms

By creating an account or using AgentIQ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). AgentIQ is operated by Colorado Home Protection, LLC ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AgentIQ is a software-as-a-service platform designed for licensed insurance professionals. The Service provides AI-powered carrier underwriting guidance, medication lookup tools, and live call coaching to assist agents in evaluating life insurance eligibility. AgentIQ does not provide insurance quotes, bind coverage, or constitute legal, medical, or financial advice.

3. Eligibility

You must be at least 18 years old and a licensed insurance professional (or acting under the supervision of one) to use the Service. By registering, you represent and warrant that you meet these requirements. Use of the Service for any purpose unrelated to legitimate insurance sales activities is prohibited.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at Charlesheathpro@gmail.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.

5. Subscription Plans and Billing

AgentIQ offers the following plans:

• Free Trial: 10 carrier match queries, no credit card required.
• Basic ($15/month): Continued access to carrier matching and underwriting tools.
• Unlimited ($30/month): Unlimited queries and all features.
• Live Call Add-on ($7.50/month): Real-time objection coaching during calls, 100 sessions/month. Requires an active Basic or Unlimited subscription.

Subscriptions are billed monthly in advance via Stripe. All payments are non-refundable except as required by applicable law. You may cancel your subscription at any time; access continues until the end of the current billing period.

6. Acceptable Use

You agree not to:

• Use the Service to make final underwriting decisions or representations to clients without independently verifying carrier guidelines.
• Enter client health information using the client's full legal name (use initials or a partial identifier only — see Section 8).
• Share your account credentials with others or allow unauthorized users to access the Service.
• Attempt to reverse engineer, scrape, or extract the AI models, carrier rules, or underlying data.
• Use the Service in violation of any applicable federal, state, or local law or regulation, including insurance licensing requirements.

7. AI Output Disclaimer

All AI-generated recommendations, carrier eligibility assessments, and coaching responses are provided for informational purposes only. They are based on general carrier underwriting guidelines and do not constitute a formal underwriting decision. Carriers make their own independent underwriting determinations. You are solely responsible for verifying AI output against current carrier guidelines before taking any action or making any representation to a client.

8. Client Health Information — Your Obligations

AgentIQ is a tool for insurance professionals, not a covered entity or business associate under HIPAA. However, you are responsible for complying with all applicable privacy laws in your jurisdiction. When entering client information into AgentIQ:

• Do not enter a client's full legal name alongside their health information. Use initials, a client code, or first name and last initial only (e.g., "J.S." or "John S.").
• Obtain appropriate consent from your clients before using their health information in any third-party tool.
• Do not enter information for individuals who have not expressly authorized you to seek insurance on their behalf.

By entering any client information, you represent that you have obtained all necessary consent and are complying with applicable law.

9. Intellectual Property

All content, features, and functionality of the Service — including carrier rule content, AI prompts, and interface design — are the exclusive property of Colorado Home Protection, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may terminate your account by contacting us at Charlesheathpro@gmail.com. Termination does not entitle you to a refund of any prepaid subscription fees.

11. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, loss of clients, or errors in carrier eligibility assessments — arising out of or related to your use of the Service. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI recommendations will be accurate or complete.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Colorado.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
