Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs how licensed insurance professionals ("Users") may use AgentIQ (the "Service"), operated by Colorado Home Protection, LLC ("Company"). By using the Service you agree to this AUP in addition to the Terms of Service and Privacy Policy.

2. Intended Users

AgentIQ is designed exclusively for use by licensed life and health insurance agents and brokers acting in a professional capacity. You must maintain any applicable state or federal licenses required to discuss or place insurance coverage with clients. Use by unlicensed individuals is strictly prohibited.

3. Health Information — Your Responsibility

AgentIQ allows you to enter client health details (age, medical conditions, medications, etc.) to generate carrier underwriting recommendations. You, not the Company, are solely responsible for how you collect, handle, and transmit any client health information.

By using the Service you represent and warrant that:

• You have obtained any consent required under applicable law before entering a client's health information into the Service.
• You will never enter a client's full legal name alongside health information. Client identifiers must be limited to initials or a partial name (e.g., "J.S." or "John S.") sufficient to identify the quote in your records without creating a linkable health record.
• You will not enter Social Security numbers, dates of birth, home addresses, financial account numbers, or any other information that could constitute Protected Health Information ("PHI") under HIPAA or Personally Identifiable Information ("PII") beyond what is necessary to obtain an underwriting recommendation.
• You understand that AgentIQ is not a HIPAA-covered entity or business associate. The Service is an underwriting research tool, not a health records system, and is not designed or certified for PHI storage.

4. Prohibited Uses

You may not use the Service to:

• Store, transmit, or process Protected Health Information as defined by HIPAA.
• Link a client's full name to any health, medical, or financial details within the platform.
• Conduct underwriting or solicit insurance for clients without the required licenses.
• Misrepresent AI-generated carrier recommendations as guaranteed underwriting decisions or formal quotes.
• Share your account credentials, quotes, or AI outputs in a manner that violates any applicable privacy law or your professional obligations.
• Circumvent credit limits, abuse trial access, or create multiple accounts to obtain free credits.
• Use the Service for any unlawful purpose or in violation of any federal, state, or local law.

5. AI Recommendations — No Guarantee

Carrier recommendations generated by AgentIQ are informational only and are based on information you provide. They do not constitute a binding underwriting decision, a formal insurance quote, or legal or compliance advice. Underwriting decisions are made solely by the insurance carrier. You are responsible for verifying all recommendations against current carrier guidelines before presenting options to a client.

6. Data Minimization

You agree to enter only the minimum amount of client information necessary to obtain a useful recommendation. The Service enforces technical controls (such as prohibiting full-name client identifiers) to assist with data minimization, but these controls are supplementary to — not a substitute for — your own professional obligations.

7. Limitation of Liability

The Company is not responsible for any breach, disclosure, or misuse of client health information resulting from your use of the Service. You agree to indemnify, defend, and hold harmless Colorado Home Protection, LLC and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of this AUP, applicable law, or your professional duties.

8. Enforcement

Violation of this AUP may result in immediate suspension or termination of your account without refund, at the Company's sole discretion. We reserve the right to report violations to applicable regulatory bodies where required by law.

9. Changes to This Policy

We may update this AUP at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised policy. Material changes will be communicated via the email address associated with your account.
